Boy, 8, charged with killing two, including dad

FLAGSTAFF, Arizona - It's a crime that police officers in a small eastern Arizona community can hardly fathom yet have to deal with: an 8-year-old charged in the fatal shootings of his father and another man.

"Who would think an 8-year-old kid could kill two adults?" St. Johns Police Chief Roy Melnick said Friday.

The killings on Wednesday sent shock waves through St. Johns, a community of about 4,000 people. The boy had no disciplinary record at school, and there was no indication he had any problems at home, prosecutors said.

"It was such a tragedy," said the boy's defense attorney, Benjamin Brewer. "You have two people dead; you have an 8-year-old in jail. It tugs at the heart strings. It's a shocker, no doubt about it."

On Friday, a judge determined there was probable cause to show that the boy fatally shot his father, Vincent Romero, 29, and Timothy Romans, 39, with a .22-caliber rifle. The boy faces two counts of premeditated murder. Under Arizona law, charges can be filed against anyone 8 or older.

Apparent confession

Melnick said the boy didn't act on the "spur of the moment," though he didn't elaborate on what the motive might have been.

Melnick said officers arrived at Romero's home within minutes of the shooting Wednesday. They found one victim just outside the front door and the other dead in an upstairs room.

Romans had been renting a room at the Romero house, prosecutors said. Both men were employees of a construction company working at a Salt River Project power plant near St. Johns, which is about 170 miles northeast of Phoenix.

The boy went to a neighbor's house and said he "believed that his father was dead," said Apache County attorney Brad Carlyon.

Melnick said police obtained a confession from the boy, but Brewer said police overreached in questioning the boy without representation from a parent or attorney and did not advise him of his rights.

"They became very accusing early on in the interview," Brewer said. "Two officers with guns at their side, it's very scary for anybody, for sure an 8-year-old kid."

A judge ordered a psychological evaluation of the boy, who was being held at the Apache County juvenile detention center.

'Ton of factors'

Prosecutors aren't sure where the case is headed, Carlyon said.

"There's a ton of factors to be considered and weighed, including the juvenile's age," he said. "The counter balance against that, the acts that he apparently committed."

Carlyon said the boy had no record of complaints with Arizona Child Protective Services.

"He had no record of any kind, not even a disciplinary record at school," he said. "He has never been in trouble before."

FBI statistics show instances of children younger than 11 committing homicides are very rare. According to recent FBI supplementary homicide reports, there were at least three such cases each year in 2003, 2004 and 2005; there were at least 15 in 2002. More recent statistics weren't available, nor were details of the cases.

Earlier this year in Arizona, prosecutors in Cochise County filed first-degree murder charges against a 12-year-old boy accused of killing his mother.

Romero had full custody of the child. The boy's biological mother visited St. Johns during the weekend from Mississippi, and returned to Arizona after the shootings, Carlyon said.

Brewer said the boy appeared to be in good spirits, but "he's scared."

"He's trying to be tough, but he's scared," Brewer said.

Boy 'killed father after 1,000 smacks'

An eight-year-old US boy accused of murdering his father and a family friend kept a tally of his parents' smackings, vowing that the 1,000th time would be the last, police believe.

The unnamed boy allegedly shot dead his father, Vincent Romero, 29, and Timothy Romans, 39, their lodger, at the family home in St Johns, Arizona, with a .22 rifle as they were coming home from work at a local power plant.

The double murder on Nov 5 shocked the US, with investigators initially struggling to find any motive.

However, according to police records reported by the Arizona Republic, the boy "is believed to have made ledgers and/or communicated in the form of writings about his intentions" if his father and stepmother continued to smack him.

According to the police records, the boy told a Child Protective Services official that "when he reached one thousand spankings . . . that would be his limit. [The boy] kept a tally of his spankings on a piece of paper."

Despite his age, relatives suspected the boy immediately in the shootings. His grandfather told investigators: "If any 8-year-old was capable of doing this, [the boy] was", and the child's grandmother added: "I knew this was going to happen, they were too hard on [him]."

The boy told police he was smacked the day before the shootings for failing to finish schoolwork.

Records indicate the boy had no history of psychiatric care and was not on any medication.

Police say he gave conflicting accounts about the shootings, initially saying he discovered the bodies when he returned home from school.

He later changed his story, admitting he shot each man twice to end their suffering after they had been shot by an unknown assailant.

In an interview whose contents was later released by police, the boy admitted he been angry with his father after the latter asked his stepmother to smack him for not bringing some schoolwork home.

At the end of the interview, he buried his head in his jacket. Asked by an officer what he was thinking, he replied: "I'm going to go to juvie."

I just don't understand this story. There are so many things that just don't add up. This kid should be taken care of not locked up. He is after all 8 years old with no undertsanding of the consequenses of his actions.

I doubt he’ll be locked up in jail. It sounds like they’ll put him in a mental hospital for awhile.

Benjamin Brewer Negotiates Plea Deal For 8-Year-Old Who Killed 2 People

As the plot thickens for the 8-year-old boy in St. Johns was accused of killing his father, 29, and his father's friend Timothy Romans, 39, as a plea deal may or may not be accepted by the boy's attorney. As of right now, the boy confessed to shooting his dad and his dad's friend. The punishment has yet to be decided upon.

The boy's attorney, Benjamin Brewer told the court that he will be doing his best to make sure the boy understands the legal implications of the offer and also will be making sure that the kid undergoes mental evaluations. The current plead deal that is being looked at right now will rest on the mental-health evaluations results. Which means the case will not make it to adult court. Three extensive mental health evaluations are scheduled and the boy will go to see how his fate will be decided.

The charges started on Nov. 5 when the boy was a suspect to the murder of his father and his father's friend Timothy Romans. The story he told changed many times, at first he said he was just walking around the neighborhood and came home and found them dead. The second story he told he said he came home and found that a stranger had shot them, the person who shot them sped away in a car when he got home. He then proceeded to shoot his father because the boy said he was suffering. The third story he told a story of how he shot them both, and the boy seemed to not know the implications of his actions. There was no remorse, tears, and or a lack of better words just plain emotion. It's hard to believe a 8-year-old could have the stomach for this, let alone lie about it.

Many think that the court will go after the boy after he turns 15 to file adult penalties and Benjamin Brewer is currently fighting all chances of that happening.

Thanks for the article update. Had already read it. Just found it strange that when reading the articles it seems he killed them because he didn't want to be beaten again by his dad. Just think there is more to the story. A boy doesn't go and kill two people for no reason and to begin with lies about it. Also is it commen in the states that a crime you comitted when you are underage you can be prosecuted for when you come of age? I understand if your 15 but 8??

The news story made me think that parents who spank their kids a lot might want to think twice about it. People can only be pushed so far and then they snap.
