5,000 Armed Militia Members Will Be Arriving in Bunkerville, Nevada Today

Update: Word on the street from sources close to the militia movement is that up to 5,000 armed militia members will be arriving in Bunkerville, Nevada sometime today. (See full report below)

SHTFplan.com Editor’s Note: It is apparent that the Federal government was under the impression that they could simply move into the ranch land surrounding Bunkerville, NV and have their way with the property and livelihood of the Bundy family. What they didn’t count on was the outcry from Americans across the country. And now things may be headed to the next level. As Kim Paxton of The Daily Sheeple notes, citizen militias in several states have been called up. Many members of those organizations are taking up arms and are making their way to Nevada.

And it’s not just the citizen militias that are preparing to take action. The governor of Nevada has officially condemned the federal government’s actions, though he has yet to take any steps afforded to him under State law. Sheriff Richard Mack of Gilbert, Arizona has weighed in and calls the actions “terrorism.”

At last count there were some 200 federal agents from various agencies on the ground in Nevada and it appears that hundreds, perhaps thousands, of armed militia members will soon arrive to confront them.

The Federal government will no doubt step up their efforts, as they are facing the possibility of a widespread rebellion resulting from their actions against a private citizen whose only “crime” was to graze his cattle on the land his family has used for this purpose for over a century. It would not be at all surprising to see the President of the United States call up National Guard troops and more militarized law enforcement officials for fear of having this spiral out of control. A declaration of martial law to go along with already established First Amendment Areas is not out of the question.

We may well be on the cusp of a serious stand-off involving thousands of people. Keep in mind that most of them will be armed.

Given the circumstances, things could turn very bloody very quickly.

Militias Are On Route: Is the 2nd American Revolution Starting in Bunkerville, Nevada?

An area just outside of the little town of Bunkerville, Nevada, with a population of around a thousand people, may go down in history.  This little spot in the desert may be compared with Lexington, Massachusetts, the site of the “shot heard round the world” – the first shot fired in the American Revolution.  Because it looks like the second American Revolution may start there…and soon.

Yesterday, The Daily Sheeple reported that tensions were running high outside of Bunkerville. It seems that the US government, in all of their infinite wisdom, has declared war on a cattle rancher named Cliven Bundy.

    In a stand-off that has been likened to Ruby Ridge and Waco, the federal government has now deployed armed agents in a case of what the U.S. Department of the Interior’s Bureau of Land Management (BLM) has deemed “trespass cattle,” escalating a 20-year battle over grazing rights and what actually constitutes “public land” use in Southern Nevada.

    Cliven Bundy, a 67-year-old rancher says his family has worked the 600,000-acre Gold Butte area since the late 1800s and that they were there well before the government’s Land Management Bureau ever came along. (source)

Armed federal officers have arrived to steal Bundy’s cattle and close down the land he is using.  What’s more, they have declared a zone around the area to be free of the restrictions of the Constitution, specifically, the First Amendment right to assemble and speak freely. They’d like to keep their reprehensible actions quiet and out of the public eye. It’s really difficult to mow down a bunch of protesters ala Waco with the whole world watching.

Yesterday, tensions began to rise even further and numerous protestors were tazed and assaulted.  (You can see the actions of those brave BLM officers on this video HERE).

It looks like tensions will rise even further because Americans have had enough.

Militias have been mobilised. It’s going to get real.

Bundy may be facing down a bunch of armed federal thugs but he’s going to be backed up by militia members from across the country.

This is the day that Patriots have been talking about and training for. They will not stand down.

CBS reports that militias from Texas, Montana, Utah, New Hampshire, and Florida will be standing with Bundy against the Bureau of Land Management.

If you aren’t a combatant, this doesn’t mean that you can’t participate in this revolt against tyranny.  This is a call to action.

Share information in support of these people who refuse to stand idly by while theft, violence, and tyranny occurs at the hands of the government.  If we all spread the word, there is no way that another Ruby Ridge or Waco can quietly occur. Time to hold our ground and bite back!

An alien group said that human beings had lost their courage but not THIS GROUP OF BRAVE PEOPLE! WE need to support them any way we can as a last gasp if nothing else.

That same group said that more benevolent groups would like to assist us but they're not able to take on the evil Reptilian *ssholes who control this planet and (ALL) of the "effective" politicians and so cannot get through to do so.

We're on our own in a way but we have the numbers (7 billiion) - 99% too cowardly or programmed to do anything.

The government is getting crazy and something needs to be done about it. Here's another crazy story:

Feds threaten $75,000 a day fine against family that built pond on their own farm

(NaturalNews) Because of overreaching federal bureaucracy that constantly churns out conflicting and onerous regulations, it is becoming more and more difficult for landowners to use their own property in ways they see fit, even if they don't harm others or the environment.

As reported by Fox News, Wyoming welder and landowner Andy Johnson and his wife, Katie, just wanted to build a stock pond on their sprawling eight-acre farm. The two of them spent many hours digging and building, and when it was ready, they filled it with crystal-clear water, adding brook and brown trout, as well as ducks and geese.

It was also a pond from which their horses could drink while grazing, and it served, too, as a sort of private playground for their kids.

Enter Washington:

But instead of enjoying the fruits of his labor, the Wyoming welder says he was harangued by the federal government, stuck in what he calls a petty power play by the Environmental Protection Agency. He claims the agency is now threatening him with civil and criminal penalties -- including the threat of a $75,000-a-day fine.

"I have not paid them a dime nor will I," a defiant Johnson told FoxNews.com. "I will go bankrupt if I have to fighting it. My wife and I built [the pond] together. We put our blood, sweat and tears into it. It was our dream."

However, the Johnsons might be in for some rough times.

All the weight of the federal government

The federal government claims that the couple is in violation of the Clean Water Act, because they built a dam or a creek without permission (which entails buying a permit) from the Army Corps of Engineers. Also, the EPA claims that substances from his pond are being discharged into nearby waterways.

Johnson, however, maintains that he built a stock pond -- not a dam or creek -- which is a man-made body of water meant to attract wildlife, and as such is exempt from current Clean Water Act regulations (the EPA is considering new regulations to change that).

The welder and property owner says he abided by state rules for the construction of a stock pond when he and his wife built it in 2012. He even has a letter, dated April 4 of that year, from the Wyoming State Engineer's Office to prove it.

"Said permit is in good standing and is entitled to be exercised exactly as permitted," the state agency letter to Johnson said.

As you might expect, the EPA doesn't much care about the state office; officials there say they, not the state or the Johnsons, have the final say in the matter. And they want Johnson to restore his land or face the penalties.

U.S. senators take up Johnson's cause

Johnson says he's not backing down. "This goes a lot further than a pond," he told FoxNews.com. "It's about a person's rights. I have three little kids. I am not going to roll over and let [the government] tell me what I can do on my land. I followed the rules."

When he first received the EPA's administrative order, he said he was "bombarded by hopelessness."

But then he said he went to state lawmakers, who fast-tracked his plea for help to Wyoming's two U.S. senators, John Barrasso and Mike Enzi, as well as Sen. David Vitter of Louisiana, all Republicans.

The trio sent a letter March 12 to Nancy Stoner, the agency's acting assistant administrator for water, stating they were "troubled" by the Johnsons' case and demanding that the EPA withdraw its compliance order.

"Rather than a sober administration of the Clean Water Act, the Compliance Order reads like a draconian edict of a heavy-handed bureaucracy," said the letter.

The order was issued by the EPA Jan. 30; it gave the Wyoming landowner 30 days to hire a consultant and have that person assess the impact of the alleged unauthorized discharges.

'We're reviewing it'

"The report was also supposed to include a restoration proposal to be approved by the EPA as well as contain a schedule requiring all work be completed within 60 days of the plan's approval," FoxNews.com reported.

So far, Johnson has not complied; if he stays that course, he is subject to $37,500 per day in civil penalties and another $37,500 per day in fines for violations of statutes.

In their letter, the senators questioned the EPA's stance that Johnson had built a dam and not a stock pond.

"Fairness and due process require the EPA base its compliance order on more than an assumption," they wrote. "Instead of treating Mr. Johnson as guilty until he proves his innocence by demonstrating his entitlement to the Clean Water Act section 404 (f)(1)© stock pond exemption, EPA should make its case that a dam was built and that the Section 404 exemption does not apply."

The EPA told the network that it is reviewing the letter. "We will carefully evaluate any additional information received, and all of the facts regarding this case," a spokeswoman for the agency said.

The real reason for the Bundy Ranch showdown has been exposed as a Bureau of Land Management attempt to cover-up Sen. Reid and his Chinese government partner’s takeover of the ranch for a solar farm, a coverup that even involves the government deleting evidence on its websites.

An intense showdown in the state of Nevada between a family of ranchers and federal agents continues to escalate after a longstanding land dispute two decades in the making, according to Russia Today, came to a head earlier this month.

Hundreds of armed agents with the United States Bureau of Land Management and the Federal Bureau of Investigation have descended on the Clark County, Nevada ranch of 67-year-old Cliven Bundy to execute the court-ordered confiscation of nearly 1,000 cattle, according to his family, which the US government says have trespassed on federal property.

By Monday this week, 234 of the 908 cattle had been wrangled up by government agents and their contractors, and news of the dispute has since further propelled the story into the national spotlight, according to The Washington Free Beacon newspaper. Now, local cowboys have retrieved some of the confiscated cattle, and supporters of Bundy ranch from around the region have flocked to Nevada to defend the ranch.

What had not been released until this afternoon, however, is that the Bureau of Land Management, whose director was Sen. Harry Reid’s (D-Nev.) former senior adviser, has purged documents from its web site stating the agency wants Nevada rancher Cliven Bundy’s cattle off of the land, that his family has worked for over 140 years, for solar panel power stations.
 The first segment of the document pulled by the feds from BLM.gov.

Deleted from BLM.gov but reposted for posterity by the Free Republic, the BLM document entitled “Cattle Trespass Impacts” directly states that Bundy’s cattle “impacts” solar development, more specifically the construction of “utility-scale solar power generation facilities” on “public lands.”

“Non-Governmental Organizations have expressed concern that the regional mitigation strategy for the Dry Lake Solar Energy Zone utilizes Gold Butte as the location for offsite mitigation for impacts from solar development, and that those restoration activities are not durable with the presence of trespass cattle,” the document states.

Another BLM report, Regional Mitigation Strategy for the Dry Lake Solar Energy Zone, (BLM Technical Note 444) reveals Bundy’s land is in the “Dry Lake Solar Energy Zone and surrounding area,” part of a broad U.S. Department of Energy program for “Solar Energy Development in Six Southwestern States” on land “managed” by BLM.

“In 2012, the BLM and the U.S. Department of Energy published the Final Programmatic Environmental Impact Statement (PEIS) for Solar Energy Development in Six Southwestern States,” the report reads. “The Final Solar Programmatic Environmental Impact Statement assessed the impact of utility-scale solar energy development on public lands in the six southwestern states of Arizona, California, Colorado, Nevada, New Mexico, and Utah.”

“The Approved Resource Management Plan Amendments/Record of Decision (ROD) for Solar Energy Development in Six Southwestern States implemented a comprehensive solar energy program for public lands in those states and incorporated land use allocations and programmatic and SEZ-specific design features into land use plans in the six-state study area.”

In 2012, the New American reported Harry Reid’s son, Rory Reid, was the chief representative for a Chinese energy firmplanning to build a $5-billion solar plant on public land in Laughlin, Nevada. Marcus Stern with Reuters also reported that Sen. Reid was heavily involved in the deal as well.

“[Reid] and his oldest son, Rory, are both involved in an effort by a Chinese energy giant, ENN Energy Group, to build a $5 billion solar farm and panel manufacturing plant in the southern Nevada desert,” he wrote. “Reid has been one of the project’s most prominent advocates, helping recruit the company during a 2011 trip to China and applying his political muscle on behalf of the project in Nevada.”

“His son, a lawyer with a prominent Las Vegas firm that is representing ENN, helped it locate a 9,000-acre (3,600-hectare) desert site that it is buying well below appraised value from Clark County, where Rory Reid formerly chaired the county commission.”

Although these reports are in plain view, the mainstream media has so far ignored this link.

The BLM’s official reason for encircling the Bundy family with sniper teams and helicopters was to protect the endangered desert tortoise, which the agency has previously been killing in mass due to “budget constraints.”

“A tortoise isn’t the reason why BLM is harassing a 67 year-old rancher; they want his land,” journalist Dana Loesch wrote. “The tortoise wasn’t of concern when [U.S. Senator] Harry Reid worked with BLM to literally change the boundaries of the tortoise’s habitat to accommodate the development of his top donor, Harvey Whittemore.”

“Reid is accused of using the new BLM chief as a puppet to control Nevada land (already over 84% of which is owned by the federal government) and pay back special interests,” she added. “BLM has proven that they’ve a situational concern for the desert tortoise as they’ve had no problem waiving their rules concerning wind or solar power development. Clearly these developments have vastly affected a tortoise habitat more than a century-old, quasi-homesteading grazing area.”

“If only Cliven Bundy were a big Reid donor,” says Infowars.

NEW YORK – When Nevada rancher Cliven Bundy refused to take his cattle off land the federal government demanded for the habitat of an endangered desert tortoise, it focused the nation’s attention on an arena Sen. Harry Reid, D-Nev., may have preferred to be kept quiet.

An investigative report published last week by Infowars.com drew a connection between Senate Majority Leader Reid’s involvement with Chinese energy giant ENN, Chinese efforts to build massive solar facilities in the Nevada desert and the showdown between Bundy and the U.S. Bureau of Land Management, or BLM.

It wasn’t the first report to notice curious dealings involving the Chinese and America’s top Democrats.

On Jan. 20, 2013, WND warned Chinese government-backed economists were proposing a plan to allow Chinese corporations to set up “development zones” in the United States as part of a plan proposed by the Chinese government to convert into equity the more than $1 trillion in U.S. Treasury debt owned by the Chinese government.

The next day, Jan. 21, 2013, WND documented the Obama administration had begun to allow China to acquire major ownership interests in oil and natural gas resources across the USA.

China grabs oil interests in USA

The first major intrusion of China in the U.S. oil and natural gas market can be traced to the Obama administration decision in October 2009 to allow state-owned Chinese energy giant China Offshore Oil Corporation, or CNOOC, to purchase a multi-million dollar stake in 600,000 acres of South Texas oil and gas fields.

By allowing China to have equity interests in U.S. oil and natural gas production, the Obama administration reversed a policy of the Bush administration that in 2005 blocked China on grounds of national security concerns from a $18.4-billion dollar deal in which China planned to purchase California-based Unocal Corp.

China’s two, giant, state-owned oil companies acquiring oil and natural gas interests in the USA are CNOOC, 100-percent owned by the government of the People’s Republic of China, and Sinopec Group, the largest shareholder of Sinopac Corporation, an investment company owned by the government of the People’s Republic of China, incorporated in China in 1998, largely to acquire and operate oil and natural gas interests worldwide.

On March 6, 2012, the Wall Street Journal compiled a state-by-state list of the $17 billion in oil and natural gas equity interests CNOOC and Sinopec have acquired in the United States since 2010.

    Colorado: CNOOC gained a one-third stake in 800,000 acres in northeast Colorado and southwest Wyoming in a $1.27-billion pact with Chesapeake Energy Corporation.
    Louisiana: Sinopec has a one-third interest in 265,000 acres in the Tuscaloosa Marine Shale after a broader $2.5-billion deal with Devon Energy.
    Michigan: Sinopec gained a one-third interest in 350,000 acres in a larger $2.5-billion deal with Devon Energy.
    Ohio: Sinopec acquired a one-third interest in Devon Energy’s 235,000 Utica Shale acres in a larger $2.5-billion deal.
    Oklahoma: Sinopec has a one-third interest in 215,000 acres in a broader $2.5-billion deal with Devon Energy.
    Texas: CNOOC acquired a one-third interest in Chesapeake Energy’s 600,000 acres in the Eagle Ford Shale in a $2.16-billion deal.
    Wyoming: CNOOC has a one-third stake in northeast Colorado and southeast Wyoming after a $1.27-billion pact with Chesapeake Energy. Sinopec gained a one-third interest in Devon Energy’s 320,000 acres as part of a larger $2.5-billion deal.

On March 6, 2012, in a separate story, the Wall Street Journal described that China’s strategy implemented since 2010 by Fu Chengyu, who has served as chairman of both CNOOC and Sinopec, involved the following components: “Seek minority states, play a passive role, and, in a nod to U.S. regulators, keep Chinese personnel at arm’s length from advanced U.S. technology.”

Harry Reid and Chinese solar investments in Nevada

On April 3, 3012, Bloomberg reported Chinese billionaire Wang Yusuo, one of China’s richest citizens and the founder of Chinese energy giant ENN Group, had teamed up with Senate Majority Leader Reid to win incentives including land 113 miles southeast of Las Vegas that ENN sought to buy for $4.5 million, less than one-eighth of the land’s $38.6 million assessed value.

Bloomberg reported ENN intended to create solar energy farms on the Nevada land, despite the nearly 50 percent plunge in solar panel prices globally in the previous 15 months that led to the bankruptcy of solar equipment maker Solyndra LLC, which had received approximately $535 million in U.S. government loan guarantees.

Bloomberg further documented ENN had contributed $40,650 individually and through its political action committee to Sen. Reid over the previous three election cycles.

Subsequently, on Sept. 4, 2012, Breitbart.com reported lawyer Rory Reid, the son of Sen. Reid, had been appointed the primary representative for ENN Energy Group, fronting the bid by the Chinese company to build a $5-billion solar panel plant on a 9,000-acre Clark County desert plot in Laughton, Nevada.

A Reuters report published on Aug. 31, 2012, documented that Reid was recruited by ENN during a 2011 trip he took to China with nine other U.S. senators, supposedly to invite Chinese investment in the United States.

The Senate group accompanying Reid on his 2011 trip to China included six other Democrats and three Republicans: Richard Shelby, R-Ala.; Barbara Boxer, D-Calif.; Dick Durbin, D-Ill.; Mike Enzi, R-Wyo.; Chuck Schumer, D-N.Y.; Frank Lautenberg, D-N.J.; Johnny Isakson, R-Ga.; Jeff Merkley, D-Ore.; and Michael Bennet, D-Colo.

“A tortoise isn’t the reason why BLM is harassing a 67-year-old rancher,” blogger Dana Loesch wrote last week. “They want his land.”

Loesch pointed out that Reid has been accused by ranchers in Nevada of using the BLM to control Nevada land, over 84 percent of which is already owned by the federal government, and to pay back special interests, including his top donor, Harry Whittemore, who first urged Reid to have the habitat of the desert tortoise moved before he was convicted of violating federal election laws by illegally funneling $150,000 to Reid’s 2007 reelection campaign.

Confirmed by a 71-28 Senate vote on April 9, BLM chief Neil Kornze served as a former senior adviser to Reid before he joined BLM in 2011, serving for the past year as the agency’s principal deputy director, according to a CBS local television news report broadcast in Carson City, Nevada.

In 2012, BLM and the U.S. Department of Energy published a “Final Pragmatic Environmental Impact Statement (PEIS) for Solar Energy Development in Six Southwestern States” that Inforwars.com charged established the basis for allowing the endangered desert tortoise to migrate habitats, paving the way to put solar energy development projects on acreage that includes public land at dispute in the Bundy standoff over grazing rights.

Loesch’s analysis of the BLM’s actions was echoed at the Moapa Valley Town board meeting last Wednesday when one of the local citizens rose to give a stirring defense of Cliven Bundy and issue a warning to the BLM.

“They can throw an army of men around there … with sniper rifles on people just like you are, men, women and children … out there, who believe they have a right to be there,” he said.

“Maybe you believe in some other place that you believe you can be. Someday they’re gonna throw that army of men around you. And then somehow they feel like they got the right … they can drop a damn tripod in the ground and set a sniper rifle on it, so if you cross a line, they can put a bullet in you. Who the hell is the man behind that trigger? I wanna know … which one of you guys gives that guy the authority to throw that rifle down? And when he does, which one of us is he going to shoot?”

“Good God, didn’t he grow up in this country? Are we gonna give it up? This is a helluva lot bigger than Clive Bundy.”

The audience erupted in applause as the man concluded his speech.

“And when Clive decides to go back in there after his cows, and they’ve got orders to shoot anyone who goes in there, I’m gonna be with him.”

Someone in the crowd piped up, “Carrying a gun I hope.”

“No, no,” he said, “because them son of a bitches will fire the next shot heard around the world … and we will fire the rest!”

Interesting, seems like the government would leave Bundy alone since it's Illuminati bloodline. Now I wonder why the producers of married with children choose Bundy as the name of the family. I have to admit I liked that show a lot. It was very funny.

Anything that's being likened to the start of the American Revolution..."the shot heard round the world" in Nevada instead of MA makes me suspicious. These long range planners deal in word/number symbols, triggers and codes. As Sovereign points out frequently...these "players" are actors.

Martin Armstrong Asks "Do The Feds Really Own The Land In Nevada?"

QUESTION: Is it true that nearly 80% of Nevada is still owned by the Federal Government who then pays no tax to the State of Nevada? This seems very strange if true as a backdrop to this entire Bundy affair.

REPLY: The truth behind Nevada is of course just a quagmire of politics. Nevada was a key pawn in getting Abraham Lincoln reelected in 1864 during the middle of the Civil War. Back on March 21st, 1864, the US Congress enacted the Nevada Statehood statute that authorized the residents of Nevada Territory to elect representatives to a convention for the purpose of having Nevada join the Union. This is where we find the origin of the fight going on in Nevada that the left-wing TV commenters (pretend-journalists) today call a right-wing uprising that should be put down at all costs. The current land conflict in Nevada extends back to this event in 1864 and how the territory of Nevada became a state in order to push through a political agenda to create a majority vote. I have said numerous times, if you want the truth, just follow the money.

The “law” at the time in 1864 required that for a territory to become a state, the population had to be at least 60,000. At that time, Nevada had only about 40,000 people. So why was Nevada rushed into statehood in violation of the law of the day? When the 1864 Presidential election approached, there were special interests who were seeking to manipulate the elections to ensure Lincoln would win reelection. They needed another Republican congressional delegation that could provide additional votes for the passage of the Thirteenth Amendment to abolish slavery. Previously, the attempt failed by a very narrow margin that required two-thirds support of both houses of Congress.

1864-Elections

The fear rising for the 1864 election was that there might arise three major candidates running. There was Abraham Lincoln of the National Union Party, George B. McClellan of the Democratic Party, and John Charles Frémont (1813–1890) of the Radical Democracy Party. It was actually Frémont who was the first anti-slavery Republican nominee back in the 1940s. During the Civil War, he held a military command and was the first to issue an emancipation edict that freed slaves in his district. Lincoln maybe credited for his stand, but he was a politician first. Lincoln relieved Frémont of his command for insubordination. Therefore, the Radical Democracy Party was the one demanding emancipation of all slaves.

With the Republicans splitting over how far to go with some supporting complete equal rights and others questioning going that far, the Democrats were pounding their chests and hoped to use the split in the Republicans to their advantage. The New York World was a newspaper published in New York City from 1860 until 1931 that was the mouth-piece for the Democrats. From 1883 to 1911 it was under the notorious publisher Joseph Pulitzer (1847–1911), who started the Spanish-American war by publishing false information just to sell his newspapers. Nonetheless, it was the New World that was desperately trying to ensure the defeat of Lincoln. It was perhaps their bravado that led to the Republicans state of panic that led to the maneuver to get Nevada into a voting position.

The greatest fear, thanks to the New York World, became what would happen if the vote was fragmented (which we could see in 2016) and no party could achieve a majority of electoral votes. Consequently, the election would then be thrown into the House of Representatives, where each state would have only one vote. Consequently, the Republicans believed they needed Nevada on their side for this would give them an equal vote with every other state despite the tiny amount of people actually living there. Moreover, the Republicans needed two more loyal Unionist votes in the U.S. Senate to also ensure that the Thirteenth Amendment would be passed.  Nevada’s entry would secure both the election and the three-fourths majority needed for the Thirteenth Amendment enactment.

1864-vote

The votes at the end of the day demonstrate that they never needed Nevada. Nonetheless, within the provisions of the Statehood Act of March 21, 1864 that brought Nevada into the voting fold, we see the source of the problem today. This Statehood Act retained the ownership of the land as a territory for the federal government. In return for the Statehood that was really against the law, the new state surrendered any right, title, or claim to the unappropriated public lands lying within Nevada. Moreover, this cannot be altered without the consent of the Feds. Hence, the people of Nevada cannot claim any land whatsoever because politicians needed Nevada for the 1864 election but did not want to hand-over anything in return. This was a typical political one-sided deal.

Republican Ronald Reagan had argued for the turnover of the control of such lands to the state and local authorities back in 1980. Clearly, the surrender of all claims to any land for statehood was illegal under the Constitution. This is no different from Russia seizing Crimea. The Supreme Court actually addressed this issue in Pollard’s Lessee v. Hagan, 44 U.S. 212 (1845) when Alabama became a state in 1845. The question presented was concerning a clause where it was stated “that all navigable waters within the said State shall forever remain public highways, free to the citizens of said State, and of the United States, without any tax, duty, impost, or toll therefor imposed by said State.” The Supreme Court held that this clause was constitutional because it “conveys no more power over the navigable waters of Alabama to the Government of the United States than it possesses over the navigable waters of other States under the provisions of the Constitution.”

The Pollard decision expressed a statement of constitutional law in dictum making it very clear that the Feds have no claim over the lands in Nevada. The Supreme Court states:

The United States never held any municipal sovereignty, jurisdiction, or right of soil in and to the territory of which Alabama, or any of the new States, were formed, except for temporary purposes, and to execute the trusts created by the acts of the Virginia and Georgia legislatures, and the deeds of cession executed by them to the United States, and the trust created by the treaty of the 30th April, 1803, with the French Republic ceding Louisiana.

So in other words, once a territory becomes a state, the Fed must surrender all claims to the land as if it were still just a possession or territory.

Sorry, but to all the left-wing commentators who call Bundy a tax-cheat and an outlaw, be careful of what you speak for the Supreme Court has made it clear in 1845 that the Constitution forbids the federal rangers to be out there to begin with for the Feds could not retain ownership of the territory and simultaneously grant state sovereignty. At the very minimum, it became state land – not federal.
