Well, here's my thoughts why listed below but... constitutional law and/or politics was NOT my major in college... so if anyone wants to argue what's below, I'm sorry, I probably can't do that without lots of research on my part... but here goes:

• Berg is appealing to the Supreme Court.  Source for that info is here.
  
• Lawsuits have been filed in 8 states seeking to require Barrack Hussein Obama to provide certification of birth in US before presidential election.  Source here.
• [size="2"]Tape of grandmother in Kenya still to be released.  She says she was there when he was born in Kenya.[/size]

• [size="2"]This photo here says "[/size]made available on Jan. 24, 2007, by the Fransiskus Assisi school in Jakarta, Indonesia, shows the registration of Barack Obama under the name Barry Soetoro into the Catholic school made by his step-father, Lolo Soetoro. The document lists Barry Soetoro as a Indonesian citizen, born on August 4, 1961 in Honolulu, and shows his Muslim step-father listed the boy's religion as Islam."  Indonesia did not allow dual citizenship meaning if this document is *correct* he renounced his American citizenship (?).

Oh... he may well be elected.  But it seems like there sure are a lot of can o' worms swirling around Mr. Obama!

"On the surface, it appears what Judge Barclay Surrick has done is demonstrate unbridled hubris in basically saying that only a Congressional majority, in this case Congressional Democrats, have the authority and standing to challenge the eligibility of Barack Obama to be President of the United States.

Under the standard written by Judge Surrick, quite literally, the Democratic Party, so long as they hold a majority in Congress, could nominate Osama bin Laden as a candidate, and so long as he receives enough electoral votes, he would become President of the United States, in spite of what the Constitution says.

Maybe this ruling isn't what it appears to be; maybe Surrick has a different agenda in this ruling.

All of you constitutional conservatives out there who are right now raging over this ruling ought to consider that perhaps what Surrick is doing here is floating a hanging curveball right into the wheelhouse of Antonin Scalia, who isn't only going to knock it out of the park, he is going to put it into the upper deck." Says Democratic senator must make request to obtain original document

HONOLULU, Hawaii – Although the legitimacy of Sen. Barack Obama's birth certificate has become a focus of intense speculation – and even several lawsuits – WND has learned that Hawaii's Gov. Linda Lingle has placed the candidate's birth certificate under seal and instructed the state's Department of Health to make sure no one in the press obtains access to the original document under any circumstances.

The governor's office officially declined a request made in writing by WND in Hawaii to obtain a copy of the hospital-generated original birth certificate of Barack Obama.

"It does not appear that Dr. Corsi is within any of these categories of persons with a direct and tangible interest in the birth certificate he seeks," wrote Roz Makuala, manager of constituent services in the governor's office, in an e-mailed response to a WND request seeking the information.

Those listed as entitled to obtain a copy of an original birth certificate include the person born, or "registrant" according to the legal description from the governor's office, the spouse or parent of the registrant, a descendant of the registrant, a person having a common ancestor with the registrant, a legal guardian of the registrant, or a person or agency acting on behalf of the registrant.

WND was told the official reason for denial of access to Obama's birth certificate would be authority granted pursuant to Section 338-18 of the Hawaii Revised Statutes, a provision the anonymous source claimed was designed to prevent identity theft.

Still, the source told WND confidentially the motivation for withholding the original birth certificate was political, although the source refused to disclose whether there was any information on the original birth certificate that would prove politically embarrassing to Obama.

The source also refused to answer WND's question whether the original document on file with the Department of Health was a hospital-generated birth certificate or a registration of birth that may have been filed subsequent to the birth.

The anonymous source made clear the Hawaii Department of Health would immediately release Obama's original birth certificate, provided Obama requested the document be released, but the Department of Heath has received no such request from the senator or from anyone acting officially on his behalf.

WND also found on microfilm in the Honolulu downtown public library a notice published under the "Births, Marriages, Deaths" section of the Honolulu Sunday Advertiser for August 13, 1961, on page B-6, noting: "Mr. and Mrs. Barack II Obama. 6085 Kalanianaole-Hwy, son, Aug. 4."

In searching through the birth notices of the Honolulu Advertiser for 1961, WND found many birth notices were published between one and two weeks after the date of birth listed.

The notice in the Honolulu Advertiser does not list the hospital where the Obama son was born or the doctor who delivered the baby.

In a startling development, Obama's Kenyan grandmother has reportedly alleged she witnessed Obama's birth at the Coast Provincial Hospital in Mombasa, Kenya.

Friday, U.S. Federal judge Richard Barclay Surrick, a Clinton appointee, dismissed a lawsuit brought by Pennsylvania attorney Phillip J. Berg who alleged Obama was not a U.S. "natural born" citizen and therefore ineligible for the presidency under the specifications of the U.S. Constitution, under Article II, Section 1.

Berg told WND last week he does not have a copy of a Kenyan birth certificate for Obama that he alleges exists.

In Kenya, WND was told by government authorities that all documents concerning Obama were under seal until after the U.S. presidential election on November 4.

The Obama campaign website entitled "Fight the Smears" posts a state of Hawaii "Certificate of Live Birth" which is obviously not the original birth certificate generated by the hospital where Obama reportedly was born.

"Fight the Smears" declares, "The truth is, Barack Obama was born in the state of Hawaii in 1961, a native citizen of the United States of America."

Although the Obama campaign could immediately put an end to all the challenges by simply producing the candidate's original birth certificate, it has not done so. And the "Fight the Smears" website offers no explanation as to why Obama has refused to request, and make public, an original hospital-generated birth certificate which the Hawaii Department of Health may possess.

Under United States law, Barack Obama, even if born outside the United States, is a US citizen. His mother was born and raised in Kansas, and met Obama's father while they were both students at the University of Hawaii. Because Barack's mother was a citizen and had lived at least ten years of her life inside the US prior to giving birth, Obama is a citizen no matter where he was born.

The claim being made by McCain's goons is that Barack's mother actually gave birth in Kenya, then flew half way around the world with a newborn baby, to smuggle him into Hawaii and fake a birth certificate here. Clearly, under US law, such a subterfuge would n9ot be needed unless somehow, Obama's parents knew that he would eventually run for President.

This whole citizenship issue is another hoax, like the "B-girl", by a campaign that cannot win on issues and plans to lie, cheat, and steal its way into the White House.

  Rezko singing; Chicago Machine concerned
  The “concerned” in the title is supposition because we’re not sure exactly what Rezko is telling Fitzgerald, but this story is starting to make the rounds in the ‘Sphere today:
  The Sun Times today gave a major clue that Barack Obama will indeed go down with Tony Rezko, sooner rather than later. It looks as though Rezko is about to turn on Alexi Giannoulias, the 30-year old State Treasurer of Illinois (who was elected only because Obama backed him).
  Here’s where all the clues are…and then we’ll walk you through the local Chicago politics on how today’s hint by the Sun Times has us convinced, for the first time ever, that prosecutor Patrick Fitzgerald could indeed send Barack Obama to jail.
  We need to repeat that: we never believed, until now, that Obama would go to jail for anything related to Rezko. Today, this breaking news about what Rezko is singing to the Feds about makes us reconsider all of that.
  Barack Obama will serve a prison sentence in the next few years — because knowing Fitzgerald, there is no reason he would be going through all of this if that was not the targeted goal in the long term.
  (1) Michael Sneed in her Sun Times column 10/10/08 had the following tidbit:
  Sneed hears rumbles political fund-raiser/fixer Tony Rezko, who is now singing sweetly to the feds from his cell at the Metropolitan Correctional Center, has been talking about his “dealings” with a Chicago bank, which has political connections.
  (2) We just spoke with someone well-connected in Chicago politics who told us that the bank Sneed is talking about has to be Broadway Bank, which is owned by the politically-connected Giannoulias family. We were told that Sneed’s column confirms rumblings people we know heard independently that Tony Rezko is giving up the Giannoulias family to Patrick Fitzgerald — Rezko and the Giannoulias family are as close and tied together as anyone in Chicago could be. If Rezko is turning on them, then Rezko is going to give up Governor Rod Blagojevich and Obama too.
  We don’t want to end up in cement shoes for implying anything here, but if you live in Chicago for any length of time, you hear rumors about Broadway Bank, the Giannoulias family, and insert Tony Soprano references here. Kapeech?
  (3) So, Rezko is singing about the Giannoulias family and its longtime “business dealings” in Chicago, which would interest someone like Fitzgerald and the Justice Department, who have had a long ambition to crack Soprano-style business dealings in Chicago (the city known for Al Capone hasn’t changed much, really). The next plate to drop in this will be Fitzgerald then leaning on the Giannoulias family to give up someone bigger than them, who Fitzgerald once discussed in terms of hoping “he has the morals to do the right thing”, to paraphrase. We now believe that person Fitz was talking about is Barack Obama.
  (4) The Giannoulias family was involved with Obama as far back as his first state senate campaign in 1996. It has been long rumored here in Chicago that Obama obtained a sweetheart deal on his first town home here in Chicago — which he could not have afforded otherwise — and guess who the financing came from for that house? We’ve been told it was Broadway Bank, the Giannoulias bank. Now, this sets up a scenario where the Giannoulias family helps Obama with his campaign finances and gets him deeper in their pocket with his sweetheart mortgage deal (for the first home he owned that he could not afford) – all in exchange for quid pro quo to be determined later.
  (5) One favor political Chicago claims Obama did for the Giannoulias family was in 2006 when, out of the blue, 29 year old Alexi Giannoulias, with no experience, and without ever having voted before, decides to run for State Treasurer of Illinois. Also out of the blue, Barack Obama endorses Alexi Giannoulias for State Treasurer. This was a SHOCK to everyone in Chicago — and Giannoulias would have never become State Treasurer without Obama’s help. In political circles here, it has always been believed that this endorsement was bought years ago with that sweetheart mortgage deal Broadway Bank arranged for Obama to buy his town house.
  (6) So, the Tony Rezko sweetheart deal was not the first magic home loan Obama ever received to buy a house he could not afford.
  Do we really think Fitz can take down Obama? Maybe, but that is completely dependent on what Rezko gives him. It’s almost assured that Giannoulias will go down, and Governor Blagojevich can’t be too comfortable with Rezko singing to the feds. But Obama? Again, we’re not so sure. It seems that Rezko, Giannoulias, and Blagojevich have a lot of interests together. Rezko helped out Blagojevich, and that was revealed in his trial, which gave Fitz more red meat for the investigation that is ongoing regarding the Illinois governor.
  At the very least, it sheds more light on Obama’s associations and judgment. It also puts him at the center of the Chicago political machine that he tries to disassociate himself from. That hasn’t exactly worked except with his supporters that are now accusing anyone who brings up his past ties to the machine as being racist. That’s an idiotic and preposterous charge as most of us who have brought these things to light haven’t uttered anything even closely resembling racism. It’s a straw man designed to silence weak-kneed conservatives and critics. Sorry, we’re not weak-kneed, and we’re not racists, so that charge ain’t exactly sticking.
  But Fitz could very well get his charges to stick, especially if he uncovers more direct links between Obama and the Chicago Machine. And if those links are discovered, then Obama — being president or not — will be in serious trouble.

  I am not surprised at all that Obama is not a natural born citizen. I am somewhat familiar with the laws in Indonesia. I also know that only Indonesian citizens can attend the public schools there. Barry attended the school there. Obama’s mother is a U.S. CITIZEN; however, she must be 19 years of age for her to confer her U.S. Citizenship to her son, Barry (Baraack). She was 18 year when she gave birth to Barry — either in Kenya (as witnessed by his Kenyan grandmother) or Hawaii, as he claims; Barry then would take on the citizenship of his birth father. British citizen (Kenya was under British control then); Barry, an illegitimate child, then became a British subject. (His Kenyan father was a married man already);
  Barry’s mother then married an Indonesian man, she, I believe had to denounced her U.S. citizenship because dual citizenship is not recognized in Indonesia, however this would not have mattered as this would not affect Obama’s status.
  Barry was then legally adopted by this Indonesian father. If Obama was adopted by his Step father as Michelle told the African Press, that adoption made Barry a citizen of Indonesia, which did NOT recognize dual citizenship. This means that Obama upon returning to the United States would have to be a NATURALIZED citizen, regardless of where he was born. He therefore is Constitutionally INELIGIBLE to run for President of the United States!!!! One has to be natural born citizen to run for the office of the Presidency.
  Based on the information being revealed to date, we can conclude that Obama is not eligible to run for the Office of the President of the US, under our Constitution. Furthermore, If Barry was never a U.S. CITIZEN, since his mother was not neet the requiste age to confer her citizenship to her son, when then did he denounce his Indonesian citizenship? And when did he become a U.S. naturalized citizen? Or is he illegally here?
  Furthermore, when did he change his name from Barry …. To Baraak Hussein Obama? What name did he use in his application to Columbia U. and Harvard ? When he went to Kansas to live with his grandparents (white), was he an Indonesian citizen then, who petitioned or sponsored for him to enter?
  The lawsuit filed in Pa requesting Obama to produce a vault birth certificate is also an indication that an imposter is running for the President of the US. Unfortunately, the PA court granted Obama’s request to dismiss, based on the shocking revelation that the COURT DOES NOT THINK THE AMERICAN PEOPLE HAVE STANDING TO BRING SUIT QUESTIONING THE CITIZENSHIP OF OBAMA. Obama and his cronies do not have to produce a legitimate birth certificate.
  The good news I have just heard is that the law firm is appealing that decision to the U.S. SUPREME COURT. This is not about race, it is about protecting and preserving the integrity of our U.S. Constitution. If Obama takes office, WITHOUT GETTING THE CITIZENSHIP AND HIS QUALIFICATION RESOLVED, he will try to amend the constitution so that he and others like him (the goernor of California or example) , naturalized citizens or illegal, can hold public offices and even the Presidency.

You must not read any of your bloggers comments. American Press International alleges they have tapes of an alleged conversation with Michelle Obama where she states that nothing will keep her husband from becoming President. She also makes statements about Obama’s adoption and citizenship. Oh, I forgot that you think any emails (thousands) that you get from your loyal views are a waste of keyboard time and you just delete them! So go to their site and it will also state they are in talks with FOX NEWS about releasing the tapes prior to Nov4th.

The rub is that, if Barack was born outside the USA, his mother didn't meet the second requirement, that 5 of her years in the USA be after age 14.  It would in fact be impossible for someone under age 19 to meet that requirement.  She was only 18 at the time of his birth.

I'm not really convinced that Berg has produced any real evidence--and I think the burden of proof is on him, not Barack.  But the essential point of his claim is that she was only 18, and hence by a loophole in the law unable to pass US citizenship on to children born outside the USA.

There is, IMHO, no really compelling evidence that Berg is correct.  But, if we were to assume that Berg is correct for the sake of argument, it would have been a situation where the family would have had an extraordinarily compelling reason to falsify records at the time--without regard to them somehow knowing about his future run for the presidency.

That being said I think that Berg's story has inconsistencies which suggest to me that Berg is grasping at straws.  For example, Berg claims that Barack lost US citizenship while in Indonesia--but it is hard for me to see how Barack could have lost US citizenship in Indonesia if he never had US citizenship in the first place--which is another claim Berg makes.  Berg also at one point claimed to have absolute proof that Barack was born in Kenya while simultaneously suggest that Barack was also born in Canada a week or two later.  Plus I don't know what to make of his claim to be doing all this for Hillary.
